2. Purpose and acceptance
These terms govern the sale, on quizoly.com, of the Quizoly pass to consumers. They are available at any time from the footer of every page and next to the payment button. Paying means accepting the terms in force on the date of the order.
3. What is sold
The Quizoly pass gives online, ad-free access to the Big Test (a set of questions drawn from every topic on the site, renewed every day) and to the quizzes and results reserved for pass holders. This is digital content supplied without a physical medium. Every category of the site keeps free, complete quizzes that need no pass.
Price and billing: €1 today, then €4.90 per week from day 8. Cancel in one click, any time.
4. Prices
Prices are in euros, all taxes included. VAT is not applicable (article 293 B of the French General Tax Code): the amount shown is the total amount paid, with no additional fees from us. Your bank may charge conversion fees if your card is not in euros. The first amount covers the first seven days; weekly billing starts on day 8. Any change to the price of an ongoing pass would be announced by email at least 30 days in advance, with the option to cancel before it applies.
5. Order and payment
Orders are placed online: the button on the Big Test page, then card payment on the secure page of our provider Stripe, where the amount is shown again before you confirm. The contract is concluded when Stripe confirms the payment; the email address entered at payment identifies you for any request. Card data is processed by Stripe and never passed on to us.
6. Access to the content
Access opens immediately after the payment is confirmed, on the device used. To open it on another device or recover it after clearing your cookies, write to ads.ericgerard@gmail.com from the address used to pay: we restore access. Access lasts as long as the pass is active.
7. Renewal and cancellation
The pass renews automatically every week, at the same price, charged to the card used, until cancelled.
You can cancel at any time, free of charge and without giving a reason, in one click from "My account" (link "Manage or cancel my pass"), or by writing to ads.ericgerard@gmail.com. Cancelling within the first seven days prevents any weekly charge. Cancellation takes effect at the end of the week already paid for: you keep access until that date and nothing is charged afterwards. The current week is not refunded pro rata, except in the cases set out in sections 8 and 9.
8. Right of withdrawal
As a rule, consumers have 14 days from the conclusion of the contract to withdraw (article L221-18 of the French Consumer Code).
However, Quizoly supplies digital content without a physical medium, whose performance starts as soon as you pay. Under article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised once the consumer has requested this immediate performance and expressly waived the right of withdrawal. This request and waiver are collected by the notice next to the payment button and by the checkbox on the Stripe payment page, before any confirmation.
If you could not access the content you bought for a reason attributable to us, write to us: we restore access or, failing that, refund you in full.
9. Legal guarantee of conformity
The digital content supplied is covered by the legal guarantee of conformity (articles L224-25-1 and following of the French Consumer Code) for as long as the pass lasts. If there is a defect, you are entitled to have it fixed free of charge or, if that is impossible or not done within a reasonable time, to a price reduction or to termination of the contract with a refund. Report the defect to ads.ericgerard@gmail.com.
10. Liability
We do our best to keep the site available and the answers accurate, but cannot guarantee uninterrupted availability (maintenance, host or network outage). Any error reported in a question is corrected.
11. Personal data
The data needed for the order (email address, payment details processed by Stripe) is used to perform the contract, give access to the content and meet our accounting obligations. It is never sold or transferred. You have the right to access, correct and erase it by writing to ads.ericgerard@gmail.com, and may contact the French data protection authority (cnil.fr).
12. Customer service and complaints
For any question or complaint: ads.ericgerard@gmail.com. We reply within 7 working days at most.
13. Consumer mediation
If a written complaint to customer service has not been resolved within two months, you can refer the matter free of charge to a consumer mediator (articles L612-1 and following of the French Consumer Code).
The appointment of our consumer mediator is in progress; their details will appear here as soon as we join. Until then, every written complaint is answered within 7 working days.
If you live in another EU country, the European Consumer Centre France (europe-consommateurs.eu) can help you free of charge with a cross-border dispute.
14. Governing law
These terms are governed by French law. If you live in another country, you keep the benefit of the mandatory consumer protection rules of your country of residence. Failing an amicable solution, the dispute may be brought before the competent court under the legal rules, including the court of your place of residence.
